MVNE.PL sp. z o.o., based in Józefów (hereinafter referred to as the “Company”), protects the personal data and privacy of its clients and users of the website www.mvne.pl (hereinafter referred to as the “Service”).  Above all, we comply with data protection regulations, and protect your data from the IT security side. We give you the opportunity to change and update your personal data at any time, and we also provide you with advice and explanations.  

The Company does not provide user data to unauthorized entities. Personal data is stored on servers and in properly secured locations, to which only authorized persons have access.  

Employees of the Company participate in training courses on personal data protection  
and management of the IT system, and the company has appropriate internal documents governing the process of personal data protection.

The Company ensures the security of personal data, particularly by protecting it from unauthorized access. Moreover, the Company guarantees compliance with the rights outlined in:

1. Who is responsible for your personal data? 

The administrator of your personal data is MVNE.PL sp. z o.o., based in Józefów (05-410), ul. Lelewela 11A, registered in the Register of Entrepreneurs maintained by the District Court for the Capital City of Warsaw, 14th Commercial Division of the National Court Register under KRS number: 0001079112, NIP: 5322109188, REGON: 527376007.

3. On what basis and for what purpose do we process your personal data? 

The Company processes personal data, among others, to ensure proper provision of services via the services through the Website and other services provided by the Company. The legal basis for processing personal data is typically the consent of the data subject or an agreement with the Company. Processing may also be based on other grounds specified in Article 6 of the GDPR. 

 

4. What is the scope of personal data processing? 

The Company processes personal data in a manner appropriate to the specific purpose of the processing, including but not limited to: 

  • Providing telecommunications services; 
  • Fulfillment of the Company’s legal obligation as an administrator, 
  • Marketing purposes; 
  • Profiling; 
  • Responding to inquiries, requests, complaints and others. 

 Each time, the content of the consent granted for the processing of personal data will specify in detail the purpose of processing and, consequently, the scope of data processing. The Company, acting as a Data Controller, collects and processes the following personal data of users through the www.mnve.pl website, i.e. name, phone number, e-mail address.   

 

5. What are your rights regarding personal data? 

Under the GDPR, you have numerous rights with respect to your personal data, including: 

a) The right of access – you may request access to your personal data at any time. 

b) The right to rectification and completion of personal data – you have the right to request the Administrator to promptly rectify your personal data that is incorrect, as well as to request the completion of incomplete personal data.  

c) The right to erasure (“right to be forgotten”) – you have the right to demand from the Administrator the immediate erasure of your personal data in any of the following cases: 

  • when personal data are no longer necessary for the purposes for which they were collected or otherwise processed,  
  • when the data subject has withdrawn the consent on which the processing is based and there is no other legal basis for the processing;  
  • when you raise an objection to the processing referred to in (e) below and there are no overriding legitimate grounds for the processing of such data;  
  • when personal data are processed unlawfully;  
  • when personal data must be erased in order to comply with a legal obligation under European Union or Polish law;  
  • when the personal data was collected in connection with the offering of information society services.  
     

However, the Administrator will not be able to delete your personal data to the extent that the processing is necessary for:  

  • exercise your right to freedom of expression and information;  
  • comply with a legal obligation requiring processing under European Union or Polish law;  
    establish, assert or defend claims.
 
d) The right to limit processing of personal data – you have the right to request the Administrator to limit processing of your data in cases where:  
  • you question the accuracy of your personal data – for a period of time that allows the Administrator to verify the accuracy of the data;
  • the processing is unlawful, and you object to the deletion of your personal data, requesting instead a restriction on its use;  
  • the Administrator no longer needs the personal data for the purposes of processing, but you need the data to establish, assert or defend your claims;   
  • you have objected to the processing referred to in (e) below – until it is determined whether the legitimate grounds on the part of the Administrator override your grounds for objection.  

e) The right to object – you have the right to object to the processing of your personal data where the Administrator is processing the data for a legitimate interest, i.e. processing for direct marketing purposes. The Controller may disregard your objection if you fail to demonstrate the existence of valid legitimate grounds for processing that override your interests, rights and freedoms, or grounds for establishing, asserting or defending claims;  

f) The right to withdraw consent – to the extent that the processing of your personal data is based on your consent, you have the right to withdraw your consent  at any time. Withdrawal of consent shall not affect the lawfulness of the processing carried out on the basis of consent before its withdrawal;  

g) The right to data portability – to the extent that your data is processed for the purpose of entering into and performing a contract or processed on the basis of consent and the processing is carried out by automated means – you have the right to receive from the Administrator in a structured, commonly used machine-readable format your personal data that you provided before or in the course of your cooperation with the Company. You also have the right to send this personal data to another Administrator.  

h) The right to complain – you have the right to lodge a complaint about the processing of your personal data by the Administrator to the supervisory authority, which in Poland is the President of the Office for Personal Data Protection.

6. With whom do we share your personal data? 

We may share your personal data with the following recipients or categories of data recipients: 

  • service providers who provide services on our behalf or for our benefit. We require compliance with applicable data protection laws in our contracts with such service providers; 
  • if such obligation arises under mandatory legal provisions,  
    to the extent necessary, also to other third parties, in particular to authorized state authorities.  

7. Transfer of personal data to third countries 

The Company does not transfer personal data to third countries. 

8. How long do we store your personal data? 

The Company makes every effort to process your personal data adequately and for as long as necessary for the purposes for which it was collected. With this in mind, the Company retains your personal data for no longer than necessary to achieve the purposes for which the data was collected or, if necessary, in order to comply with applicable law, in particular the period of performance of the contract and the period of limitation of claims.  

9. Automated decision-making 

The Company does not perform automated decision-making, including profiling  
based on the personal data provided.  

10. Amendment of the Privacy Policy  

This Privacy Policy is subject to change, in particular, if the need or obligation to conduct such changes arises from changes in applicable laws, including changes in data recipients. Persons whose data are processed in accordance with this Privacy Policy will be notified of its changes with due notice.
